A Manhattan federal court delivered the sentence on Tuesday, October 6, Smith had earlier pleaded guilty to conspiracy to commit wire fraud in March.

Prosecutors say the scheme ran from 2017 through 2024, during that period, Smith allegedly used bots to stream his music millions of times.

He also reportedly used AI-generated songs as part of the operation; investigators say he purchased and uploaded these tracks before streaming them artificially.

This Mike Smith streaming fraud case also involved a significant financial penalty, as part of his plea deal, Smith agreed to forfeit $8 million.

His sentence includes 18 months in prison; afterward, he will serve two years under supervised release.

During sentencing, Smith became visibly emotional while addressing the court; he expressed deep regret over how his actions affected his family and reputation.

“By committing this crime, I have failed miserably,” he said.

He acknowledged betraying the very music community he once loved, according to him, his passion had turned into something he described as a “perverse business model.”

Prosecutors had originally pushed for a much longer sentence they argued that 46 months in prison would send a stronger warning to others.

Smith’s legal team requested probation instead of prison time; they argued that streaming fraud laws were less clearly defined when the scheme began.

In the end, the judge chose a middle ground; Smith received 18 months in prison, shorter than prosecutors wanted but still a real penalty.
